The Kuala Lumpur High Court has fixed November 17 to deliver its decision on Najib Abdul Razak and his son Nazifuddin’s appeal seeking a stay of bankruptcy proceedings over unpaid tax arrears. The Inland Revenue Board (IRB) initiated bankruptcy actions after the pair failed to settle RM1.69 billion and RM37.6 million in taxes, respectively.
Bankruptcy Appeal
Counsel Farhan Shafee argued that proceeding with bankruptcy would render their pending tax appeal before the Special Commissioners of Income Tax meaningless. Senior revenue counsel Norhisham Ahmad countered that the IRB, as a judgment creditor, is entitled to recover the debt following the Federal Court’s dismissal of their final appeal in 2023. Judicial commissioner Suhendran Sockanathan will rule next month.
