Lawyers for Liberty (LFL) reiterated today that the Court of Appeal’s 2014 ruling invalidated sections of the Peaceful Assembly Act 2012 (PAA), which mandated Bersih to notify the police in advance.
LFL slams police warning on Bersih rally
In a statement, LFL criticized Kuala Lumpur Police Chief Allaudeen Abdul Majid’s warning against joining the Bersih rally at Parliament tomorrow, deeming it a “serious ignorance” of the PAA and the Federal Constitution.
Director Zaid Malek highlighted the Court of Appeal’s decision in Nik Nazmi Nik Ahmad v. Public Prosecutor 2014, affirming Section 9(5) of the PAA as unconstitutional, emphasizing its enduring validity despite subsequent rulings. Zaid urged police to retract threats against rally attendees, condemning the PH government’s crackdown on Bersih despite its historical support.
