Lawyers for Luigi Mangione have argued that a New York state murder trial over the 2024 shooting of UnitedHealthcare chief executive Brian Thompson would amount to double jeopardy, according to a court filing reported by ABC News on Monday (Nov 2).
The filing was submitted on Friday (Oct 30). Mangione pleaded guilty to federal stalking charges in August, admitting that he travelled to New York intending to kill Thompson and shot him outside the Midtown Hilton, ABC reported.
Mangione double jeopardy argument
The defence argues that, with his federal guilty plea, Mangione has already been sufficiently prosecuted for killing Thompson, so a state murder trial would put him in jeopardy a second time.
Defence lawyer Karen Agnifilo told reporters that New York law “does not permit a person to be prosecuted and punished twice”. The filing says the core misconduct in the federal and state cases is effectively the same.
Prosecutors say cases differ
The Manhattan District Attorney’s office, which is pushing to try Mangione in state court, has argued that the federal stalking charge and the state murder charge address different misconduct, according to ABC.
The DA’s office did not immediately comment on the latest filing, the network reported.
Sentencing and hearing in December
Mangione is scheduled to be sentenced on the federal charges in December. In the same month, Judge Gregory Carro is due to hear oral arguments on the defence motion to dismiss the state murder indictment, ABC reported.
