Lawyers for Datuk Seri Najib Razak have demanded that he be moved from Kajang Prison to his home immediately, Malay Mail reported, saying the King’s decree on his house arrest had to be carried out on Saturday (Nov 7).
In a media statement on Saturday evening, Messrs Shafee & Co contested the Attorney General’s Chambers’ (AGC) decision to put Najib’s house arrest on hold, arguing that it contradicted the explicit decree issued by the King that morning.
Lawyers cite discharge order
The firm said the High Court’s Order of Discharge on Payment of Fine, issued on Friday (Nov 6), could not be used to extend Najib’s imprisonment, pointing to the order’s own recital that the fine had been paid.
“In law, payment of a fine discharges the liability to pay that fine,” the statement said.
The lawyers argued that the pardon was an exercise of the King’s prerogative under Article 42 and was not open to review by any court or the AGC. They also said the AGC issued a later media statement 57 minutes after the King’s decree without referring to the royal order.
They asked the Commissioner General of Prisons to transfer Najib to his residence at Jalan Langgak Duta, Taman Duta, Kuala Lumpur.
Umno leaders lodge police reports over Najib house arrest delay
Several Umno leaders in Johor lodged police reports on Saturday over the delay. Pontian Umno chief Datuk Seri Ahmad Maslan filed his report at the Benut police station at 12.30pm, accompanied by division leaders, Malay Mail reported.
Umno Youth chief Datuk Dr Muhammad Akmal Saleh called for similar reports nationwide, saying state and division Youth wings would seek an investigation into whether any laws were breached in delaying the royal pardon and the related court order.
Akmal said all conditions had been met on Nov 6, when the RM50 million fine was paid at the Kuala Lumpur High Court and the Home Ministry gazetted the residence as a prison under Section 3 of the Prisons Act 1995.
Security removed from residence
Malay Mail, citing Astro Awani, reported that no police officers or Prisons Department vehicles were visible outside the Taman Duta house on Saturday, a day after security was tightened there. Yellow tape restricting access had also been removed, though journalists remained near the residence.
The AGC has said it is not challenging the pardon and has called for an urgent court ruling on whether Najib’s SRC International sentence remains in force.
