PAS has failed in its attempt to cancel the defamation lawsuit filed against them by the Deputy President of Amanah, Mujahid Yusof Rawa, against the opposition party. According to former Parit Buntar MP and lawyer, Noorazmir Zakaria, PAS applied to cancel the civil suit without hearing the full trial.
PAS failed to cancel their defamation suit
The High Court of Kuala Lumpur has set June 21 for a hearing of the cancellation application after vacating the hearing date today. In the cancellation application drafted under Order 18 Rule 19(1)(a) of the 2012 Rules of Court, PAS, sued through its Secretary-General Takiyuddin Hassan. He claimed that Mujahid had failed to disclose any reasonable cause of action against the Perikatan Nasional coalition party.
The civil action relates to a Facebook post made on October 16, which referred to when Mujahid was the Minister in charge of religious affairs under the previous Pakatan Harapan administration led by Prime Minister Dr Mahathir Mohamad from May 2018 to February 2020. The plaintiff seeks, among other things, a court order requiring Takiyuddin or PAS to make an open apology published in the Malay daily newspaper and the party’s Facebook page within 14 days of the judgment.
