In the Sam Ke Ting case – Basikal Lajak – Lawyer Hisyam Teh Poh Teik says the charges against the clerk found guilty of reckless or dangerous driving is illegal.
“The charge is illegal due to duplicity,” he says, adding that such an illegality is uncurable under Section 422 of the Criminal Procedure Code. It gives rise to a “failure of justice”.
Injustice Towards Sam Ke Ting?
Sam Ke Ting was found guilty with both “reckless driving” or “dangerous driving”, and she should have been charged with both offences “lumped together”.
