The High Court ordered political analyst Abdul Razak Baginda and others to pay RM5 million in damages to Altantuya Shaariibuu’s family. Justice Vazeer Alam Mydin Meera ruled that Razak’s refusal to testify under oath led to the court inferring that his testimony would have been adverse.

This decision was based on Section 114(g) of the Evidence Act 1950, which allows the court to presume facts from natural events and behaviors. On December 16, 2022, Justice Vazeer ordered the defendants to jointly pay RM5 million in general, aggravated, and exemplary damages to Altantuya’s family. Justice Vazeer said Abdul Razak was “complicit” in the killing, as he was the only link between the deceased and the first and second defendants. The judge said the first and second defendants did not know the deceased while Abdul Razak had wanted the harassment and embarrassment by the deceased to stop.
