KUALA LUMPUR: The Malaysian government has clarified that house arrest is possible without new laws under the Prisons Act. Minister Azalina Othman Said stated that the home minister holds the authority to declare any house a “prison” for detention purposes. This power applies to all prisoners, subject to legal provisions. The clarification follows former prime minister Najib Razak’s legal bid for house arrest under a royal decree. The government has also declassified Pardons Board meeting minutes related to Najib’s sentence reduction, amid questions over the decree’s validity issued outside the board’s meeting. “In other words, a minister has the authority to declare a house as a valid place to detain a prisoner, subject to provisions under the Prisons Act,” she said in a written parliamentary reply yesterday.
