Overseas-Born Children of Malaysian Mothers Granted Citizenship Rights

Children born overseas to Malaysian mothers and foreign fathers before the Federal Constitution (Amendment) Act 2024 can now apply for Malaysian citizenship. This follows a legal settlement between the government and six Malaysian mothers, alongside Family Frontiers, advocating for gender-equal citizenship.

The Federal Court, led by Chief Justice Tun Tengku Maimun Tuan Mat, formalized the agreement. The consent order ensures citizenship eligibility under Article 15(2), provided procedural requirements are met. Documents previously issued remain valid. The Constitution (Amendment) Act 2024 grants equal citizenship rights to children born overseas but applies only prospectively.
