In a landmark decision, Malaysia’s Federal Court has permitted the Attorney-General to appeal a ruling granting former Prime Minister Najib Razak leave to pursue judicial review over a royal decree for house arrest. The unanimous ruling, delivered by a three-member bench led by Chief Judge Hasnah Hashim, found that the AG’s seven legal questions met the threshold under Section 96 of the Courts of Judicature Act 1964. Describing the issues as novel and of public importance, the court set the stage for a significant hearing, further scrutinizing Najib’s bid to enforce the decree amidst ongoing legal battles.
