KUALA LUMPUR, Sept 25 — The High Court today heard that Najib Razak’s ongoing criminal case is unrelated to SRC International Sdn Bhd’s US$1.18 billion civil suit against him. His counsel, Tan Sri Muhammad Shafee Abdullah, said criminal and civil trials differ in their standards of proof — criminal cases require proof beyond reasonable doubt, while civil suits are decided on the balance of probabilities.
SRC Civil Suit
He stressed that civil courts are not bound by criminal findings unless further supporting materials are presented. The lawsuit, filed in 2021, concerns RM4 billion in loans from KWAP to SRC, with the company seeking damages from Najib and former CEO Nik Faisal Ariff Kamil. The hearing continues before Judge Datuk Ahmad Fairuz Zainol Abidin tomorrow.
