New: High Court Orders Retrial in Clare Rewcastle-Brown Case

Kuala Terengganu, December 15 — The High Court here has ordered a retrial in the criminal defamation case against Sarawak Report founder Clare Rewcastle-Brown, who was sentenced to two years’ jail in absentia last year for allegedly defaming Terengganu Sultanah Nur Zahirah.

Judge Radzi Harun ruled the previous magistrate’s proceedings a mistrial due to erroneous application of Section 425A of the Criminal Procedure Code, allowing trials without the accused. He set aside the conviction and sentence imposed on February 7, 2024.

Rewcastle-Brown was charged under Section 500 of the Penal Code over a paragraph in her 2018 book “The Sarawak Report – The Inside Story of the 1MDB Exposé”, later removed in subsequent editions.

The judge directed a new magistrate to handle the retrial on the same charge, potentially using prior witness depositions if the author remains absent.
