The High Court has ordered a woman and her new husband to jointly pay over RM1.2 million to her ex-husband after she hid her remarriage for eight years to continue receiving spousal maintenance. Justice Evrol Mariette Peters (now a Court of Appeal judge) ruled that the woman fraudulently obtained consent orders following their 2011 divorce by concealing her new marriage, which under Section 82 of the Law Reform (Marriage and Divorce) Act extinguished her entitlement to maintenance.
Hiding Remarriage
The court directed repayment of RM310,000 unlawfully collected from 2012–2019, plus RM400,000 in aggravated damages, RM300,000 in exemplary damages, and RM200,000 in costs. The judge held that the fraud vitiated the consent orders entirely, describing it as a “contagion” infecting the agreements.
