FOI in Malaysia: Only Selangor and Penang Offer Statutory Access

Malaysia is still awaiting a federal Freedom of Information (FOI) Act, but Selangor and Penang remain the only states with statutory “right to know” laws. Both require manual applications submitted in person, with fees of RM12 in Selangor and RM50–RM100 in Penang.

Requests are reviewed by departmental Information Officers, with turnaround times of 30 days in Selangor and 14 in Penang. Approval is not guaranteed, as exemptions cover official secrets, commercial interests, and policy formulation. 

Critics argue the laws fall short, citing ignored requests over the PJD Link project in Selangor and delays in Penang, despite court and appeals board rulings.
