SEREMBAN – The Seremban High Court has dismissed an originating summons filed by a 47-year-old woman seeking a declaration that she is not a Muslim. Judge Wan Fadhilah Nor Wan Idris ruled against the applicant and ordered her to pay RM4,000 in costs. Counsel Danial Farhan Zainul Rijal, representing Majlis Agama Islam Negeri Sembilan (MAINS), said the court relied on the woman’s repeated acknowledgements of being Muslim in her identity card, marriage, and divorce documents.
Non-Muslim?
The judge also considered her official Islamisation record at age four, following her parents, including the Kad Perakuan Masuk Islam. The court held that such records are conclusive evidence under relevant regulations and cannot be rebutted by personal claims. It further ruled the matter falls under Syariah Court jurisdiction, not civil court, and rejected the claim as invalid from the outset. The suit, filed in March 2023, named JPN, MAINS, and the federal government as respondents.
