The Human Resources Ministry (KESUMA) reminded employers against forcing employees to take annual or unpaid leave if they close businesses for extended periods during Chinese New Year (CNY).

Such practices violate Malaysia’s labour laws. The Ministry received complaints about employees being compelled to take leave due to company shutdowns beyond public holidays. Employers cannot force workers to use their leave or take unpaid leave to reduce costs. 

Leave must be voluntarily requested. Affected employees should report unlawful deductions to the Labour Office. Non-compliance with the Employment Act 1955 could lead to legal action.
