UMNO has launched a strong momentum to request a royal pardon for its former Prime Minister and UMNO President, Najib Razak. However, it is unlikely to create any rift in the federal unity government.
Najib Razak’s pardon
This is because the power of royal pardon is under the Yang di-Pertuan Agong’s authority as stated in Article 42(1) and 42(2) of the Federal Constitution. The Prime Minister’s advice is not necessary as the Agong acts after consultation with the Pardons Board under Article 42(4)(a) read with Article 40(3).
Anwar Ibrahim, the current Prime Minister, is not pressured to advise the Agong on whether to grant a pardon to Najib or not, and his government is safe. The Pardons Board, which consists of the Attorney General, a federal minister responsible, and no more than three appointed members, advises the Agong on the use of royal pardon power under Article 42(5).
