Kuala Lumpur City Hall (DBKL) has been ordered by the Sessions Court to pay RM824,180 in damages to the parents of a motorcyclist who was killed by a fallen tree in 2023. The victim, a 30-year-old man, was riding along Jalan Kuching when a tree from a road divider collapsed and struck him, leading to fatal injuries days later. The court ruled in favour of the victim’s parents, who filed the suit citing negligence.
Court Finds DBKL Negligent Over Tree Maintenance
In its judgment, the court found that the fallen tree was under DBKL’s responsibility and that the incident would not have occurred without negligence in monitoring and maintenance. It was also revealed that DBKL failed to provide evidence of proper inspection or upkeep, such as trimming or pruning. The damages awarded included RM768,000 for loss of dependency, RM26,180 for funeral expenses, and RM30,000 for bereavement.
DBKL has since filed an appeal against the decision. The case has sparked broader discussion on public safety and the responsibility of local authorities to maintain infrastructure and greenery in urban areas.
