Shariah must not override Constitution, says G25

PETALING JAYA, Sept 13 — Civil society group G25 Malaysia has warned that placing Shariah law above the Federal Constitution would undermine Malaysia’s legal framework and risk unequal treatment among citizens. The group rejected PAS president Tan Sri Abdul Hadi Awang’s call to abolish what he termed “colonial-era” laws, stressing that statutes such as the Syariah Courts (Criminal Jurisdiction) Act 1965 (Act 355), Civil Law Act 1956 and the Ninth Schedule are integral to Malaysia’s constitutional design.

G25 noted that Act 355 was enacted post-independence and amended by Parliament in 1984, while the Ninth Schedule was agreed upon by the Rulers and founding parties at Merdeka. “To call these laws colonial is an attempt to play politics with the foundation of this country,” G25 said, adding that Malaysia’s legal system was deliberately chosen by its founding fathers.
