He was charged under Section 326 of the Penal Code, which carries a jail term of up to 20 years, a fine or whipping upon conviction. Deputy public prosecutor Nurainizatul Farhana Zainal opposed bail, citing the non-bailable nature of the offence. However, the prosecution proposed RM8,000 bail with two Malaysian sureties and the surrender of the accused’s passport if bail was granted.

Defence counsel Ling Yee Siew sought lower bail, telling the court that Chen was pursuing a finance degree and was not a flight risk. He also said the accused had been diagnosed with depression. The court granted bail at RM8,000 with two Malaysian sureties and ordered the passport to be surrendered. The case has been fixed for mention on Nov 11.
