The government is reviewing the abolition of mandatory whipping as part of broader criminal justice reforms towards a more humane approach, said Minister in the Prime Minister’s Department (Law and Institutional Reform) Datuk Seri Azalina Othman Said.

The study, coordinated by the Legal Affairs Division, involves key agencies including the Home Ministry, Prison Department, Police, SUHAKAM, and the Bar Council. Findings will be submitted to the Criminal Law Reform Committee before being presented to Cabinet.
Azalina noted that 57 Penal Code provisions prescribe whipping, 26 of which are mandatory, with other laws like the Dangerous Drugs Act also mandating caning. Concerns have grown over the punishment’s physical and psychological impact, particularly after prisoner deaths linked to caning in recent years.
